The swimwear society of Marseilles Pain du Sucre got condemnation of La Redoute for "counterfeiting", as it was learnt from its lawyer, Miss Valérie Keusseyan.
The court of appeal of Aix-en-Provence inflicted on the giant of the mail order a 50.000-euro fine and made the society La Redoute give Pain du Sucre the same sum as damages because of suffered detriment. Besides, a judicial publication is envisaged in Provence and the Journal du textile.
Pain du Sucre had called La Redoute in justice in 2011 by complaining to have been "savagely copied", notably as part of the marketing of one of its models called "Mishi", model deposited in the national Institute of industrial property (INPI) in 2005 and best seller of mark. The vests that the society sells 120 - 150 euro unit are offered to the customers between 15 and 20 euro on the catalogues of La Redoute.
At first, the correctional justice of Marseilles had already condemned La Redoute for a fine of 200.000 euro and 100.000 euro of damages. "It is a nice victory. It is also the recognition of the job of creation performed by the whole team", commented Miss Keusseyan, the lawyer of Pain du Sucre, which greeted in this decision "a fair protection of economic public order".
The society of Marseilles conceives and deposits 60 models of new swimsuits every year.
