Christian Louboutin has won a trademark for its signature red soles from the US Patent and Trademark Office in 2008. The red sole shoes created a unique print on his brand and come as a way of recognition.

The luxury shoemaker sued YSL for creating similar red sole shoes that could be seen in Yves Saint Laurent’s Cruise 2011 Collection.
Judge deny Louboutin’s demand:
But, the Judge Victor Marrero denied Christian Louboutin’s demand to stop sales of other red sole shoes. “Because in the fashion industry color serves ornamental and aesthetic functions vital to robust competition, the court finds that Louboutin is unlikely to be able to prove that its red outsole brand is entitled to trademark protection” the Judge states cited by Wall Street Journal.
